General Terms and conditions,
Please find below our terms and conditions for Yachting and Yoga Retreat organized by Reka Belle (organizer). Please read them carefully and do not hesitate to contact me if you have any questions.
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”; “customer”; “client”; “participant”) and Yachting and Yoga Retreat organized by Reka Belle (“organizer”; “Retreat”; “us”; “our”; ”we”). By booking you agree that you have read, understood, and agreed to be legally bound by all of these Terms of Use.
You agree for yourself and all persons you represent to comply with all points of the agreement, in particular to pay all payments within the specified timeframe. You agree that any breach of the Agreement may result in (a) your booking being canceled, (b) all payment for your booking (s) being forfeited, (c) your access to the relevant travel services being denied, (d) us being We reserve the right to invoice you for all costs incurred as a result of your infringement.
The organizer reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of the affairs of the retreat. Any such changes will be notified to Clients and, until revoked, are and will be binding.
1. Booking
1.1 After confirmation of the booking request 500€ deposit is required to secure your booking with us. The booking fee is due within 7 days. The deposit will be deducted from the total travel price.
1.2 The remainder of the total travel price is due no later than 60 days before the start of the retreat.
1.3 If the deposit due or the total price due has not been paid or not paid in full, the organizer can withdraw from the contract after an unsuccessful reminder and a reasonable deadline for payment and charge the customer with withdrawal costs.
1.4 If a booking is made on behalf of the Client and other clients, the organizer reasonably assumes that the Client making the booking has the authority to bind the other clients, and will be treated as being jointly and severally liable for those other Clients.
1.5 To be able to participate in Yachting and Yoga Retreat you must have a valid passport and be able to travel to our destination independently. Flights are not included.
1.6 We highly recommend holiday insurance for all clients. This must be bought independently as it is not included in the retreat price. It is your responsibility to read and understand our cancellation policy before making a reservation. Please consider purchasing travel cancellation insurance.
2. Cancellation Policy
2.1 You can withdraw from the travel contract at any time before the start of the trip. All cancellations must be received in writing.

2.2 Due to the exclusivity and limited availability, deposits are non-refundable. There will be no deposit refunds provided in any circumstances, at any time.
2.3 If for whatever reason you need to cancel your retreat place after you have booked with us, the following refund policy will apply:
If you cancel within 24 hours of booking
Once you have confirmation of your booking you have a further 24 hours to cancel and obtain a full refund, including deposit.
After this period, the following conditions will apply:
120 days or more
A full refund will be provided for all cancellations up to 120 days prior to start day of the booked retreat. This excludes the 500€ per person booking fee which is non-refundable.
Between 120 - 90 days
A 50% refund will be provided on cancellations between 90-119 days prior to the start date of the booked retreat. This excludes the 500€ per person booking fee which is non-refundable.
Between 60 - 90 days
A 25% refund will be provided on cancellations between 60-89 days prior to the start date of the booked retreat. This excludes the 500€ per person booking fee which is non-refundable.
Less than 60 days
No refund will be provided on cancellations between 59-0 days prior to the start date of the booked retreat. Cancellations less than 60 days before the start date are non-refundable and will result in 100 % loss of revenue.
2.4 No refund will be provided for premature leaving of the retreat or failure to arrive at the retreat for any reason.
2.5 No refund will be provided for only part of a booking, for example if a room is booked for two guests who are sharing and one guest is unable to attend, the booking would need to be cancelled as a whole for the above refund policy to apply.
2.6 No refund will be provided for any room downgrades, after the 24hrs from the point of booking has lapsed.
2.7 If paying via instalments, the above conditions will apply based on the entire price of your booking and not just on any instalments paid.
2.8 All retreat payments are due 60-days prior to the start date of the booked retreat, unless otherwise specified. Clients whose balances are not received by the 60-day deadline, risk forfeiting their retreat booking.
3. Withdrawal and termination by the organizer
3.1 The organizer reserves the right to make changes in the schedule, Route, and Boat/accommodation as it is necessary due to weather conditions and/or political/organizational/technical reasons. There is no entitlement to the presence of the seminar leader mentioned. This can also be replaced by an equally qualified teacher.
3.2 The organizer reserves the right to cancel or postpone a retreat up to 14 days before the start of the trip if the minimum number of participants has not been reached. If the retreat is cancelled by the organizer you will receive back the payments you made within 30 days. In case of the retreat is postponed the fees shall be applicable to the rescheduled retreat. The organizer is not responsible for expenses incurred in preparation for any cancelled retreats such as other accommodation, airline tickets, loss of work, and /or other costs associated with preparing for your trip.
3.3 The organizer reserves the right to terminate use of the retreat venue and facilities by the Client in the event of any breach of the Terms and Conditions and/or if they are deemed to be acting in a manner that is deemed (at the discretion of the organizer solely) detrimental to the enjoyment of other Clients on the Retreat. In these circumstances the Client will be required to vacate the Retreat immediately and no refund will be provided by the organizer to the ejected Client, not will the organizer be liable for any resulting cost and/or loss arising from the ejection.
3.4 If the trip is made considerably more difficult, endangered or impaired as a result of force majeure that was not foreseeable when the contract was concluded, the organizer can terminate the contract. Thereafter, the organizer can demand appropriate compensation for travel services that have been or are still to be provided.
4. Obligations of the traveler
4.1 The traveler is responsible for compliance with all regulations that are important for the implementation of the trip. All disadvantages that arise from non-compliance with these regulations are at the travelers own expense. The traveler is responsible for obtaining or carrying the necessary travel documents and must ensure that his passport or identity card, and visa requirements are sufficiently valid for the trip. If you have not received your travel documentation / travel documents at least 8 days before departure, we ask for immediate notification.
4.2 The participant guarantees that he / she feels able to take part in the sometimes intensive group processes and is ready to take responsibility for himself. The Client must comply with all instruction given by the yoga instructor on the Retreat and must ensure that they are both suitably medically and physically fit enough to participate on the Retreat. If the Client is unsure of this, they MUST seek the advice and consent of a qualified doctor in order to participate. You agree to sign a waiver with Yachting and Yoga Retreat at least 30 days before your retreat Start Date.
4.3 Every participant of Yachting and Yoga retreat agrees to take responsibility for their own health, well-being and harmony in the group. This means participating in group processes in a considerate way. Of course, always with the possibility to withdraw if desired.
4.4 The Client shall keep all of the Retreats' fixtures, fittings, furniture and effects in a clean and good condition and shall replace any articles, which are destroyed, damaged or missing with articles of a similar kind and of equal value. Any defects that occur must always be reported immediately to the local tour guide.
5. Limitations of liability
5.1 You acknowledge that during any trip with Yachting and Yoga Retreat you participate voluntarily in any and all activities arranged, and insofar as is legally permissible, you surrender your right to any cause of action against Yachting and Yoga Retreat, their agents, contractor’s, employee’s and directors, arising from any loss or damage to any person or property that occurs during a Yachting and Yoga Retreat up to and including death. If you are currently pregnant, or under medical or psychiatric supervision, you must provide a Doctor’s certificate confirming your fitness to travel and take part in the retreat as well as notifying Yachting and Yoga Retreat. Yachting and Yoga Retreat is unfortunately not suitable for those with psychiatric or deep emotional issues or those looking for counselling or therapy, as our team are not professionally qualified in these areas. Our team are also not medically trained and do not know your medical history so cannot offer any specific medical advice whilst at the retreat.
5.2 The organizer will not be liable to the Client for any loss and/or damage from the Retreat when such loss and/or damage is caused by unusual and/or unforeseeable circumstances that arise which are beyond the organizer`s control, the consequences of which the organizer could not have avoided even with all due care and skill. In all circumstances, the organizer is not liable to pay the Client any additional travel or any other consequential costs, expenses or losses which the Client incurs as a result of any change, cancellation or rescheduling by the organizer, in relation to your booking of the Retreat.
5.3 Our retreat is not suitable for children under the age of 18 years or for people with physical disabilities that cannot take care or responsibility for themselves as we do not have the resources or expertise. There are areas of the retreat that people with mobility issues may not be able to access.
5.4 The organizer reserves the right to offer discounts on the Booking Cost and this does not affect the status of any Clients who have paid the full Booking Cost and no discount applied will then become due to them.
5.5 Should the Client have any complaint, this should in the first instance be raised with the Retreat host immediately, so that the organizer can look to remedy any issues. If the Client considers that the complaint has not been satisfied to their satisfaction at the time of reporting it to the Retreat host, then the complaint should be made in writing immediately, and in any event, within 14 days of the end of the Retreat to be considered.
6. Data protection
6.1 The personal data that you provide to us are processed electronically and used to the extent necessary for the establishment, implementation or termination of the travel contract and for customer service. When collecting, processing and using personal data, we comply with the provisions of the Federal Data Protection Act. You have the option at any time to call up your stored data, to request information about them, to have them changed or deleted. By sending a message to yachtingandyogaretreat@gmail.com you can object to the use or processing of your data for advertising, market or opinion research purposes. Your data will not be passed on to third parties.
6.2 You hereby grant to Yachting and Yoga Retreat the absolute and irrevocable right, and unrestricted permissions to use photographic portraits/images/videos in which you feature that are taken during the retreat to use/republish/copyright, etc. for commercial use in association with Yachting and Yoga Retreat. You hereby release and discharge Yachting and Yoga Retreat from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.
7. Other
7.1 Should one of the above provisions be or become ineffective, the remaining conditions will nonetheless remain valid and the validity of the travel contract will remain unaffected.
7.2 In order to rule out any uncertainty, we point out that the terms “we”, “us”, “our” also refer to our partners. The information and services that we publish and offer on our website may contain errors and inaccuracies, including errors in the price information. We do not guarantee the accuracy of the prices or other information and decline any responsibility for any consequences of such errors. We expressly reserve the right to correct incorrect prices or other information on our website, and in the event of a booking request that came about under such incorrect conditions, either to use the correct price information for this booking or to cancel this booking free of charge.
